Terms of Service
Last updated: September 10, 2026
These Terms of Service (“Terms”) govern access to and use of the DriverSeal driver intake platform at driverseal.com (the “Service”), operated by DriverSeal (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms.
1. Service availability
The Service is available for brokerage use. Features, availability, and pricing may change as we improve the product. We will provide reasonable notice of material changes when practicable. We may suspend or discontinue the Service or any part of it when necessary for security, legal, or operational reasons.
2. What DriverSeal does — and does not do
DriverSeal provides tools for freight brokerages to collect driver information and photographs through secure links and to review those submissions manually within a brokerage dashboard.
DriverSeal does not verify identity, insurance, carrier authority, FMCSA status, or document authenticity. Display of capture time or location metadata on a photo is not a guarantee of accuracy. Brokerages remain solely responsible for underwriting, compliance, and dispatch decisions.
3. Eligibility and accounts
- Brokerage users must be authorized by their organization and must provide accurate account information.
- You are responsible for safeguarding your sign-in credentials and for activity under your account.
- Drivers use one-time intake links and do not receive persistent DriverSeal accounts.
4. Brokerage responsibilities
If you use the Service on behalf of a brokerage, you agree that you will:
- Send intake links only for legitimate freight-related purposes
- Inform drivers why information is being collected and how it will be used
- Review submissions manually and apply your own compliance standards
- Comply with applicable laws, including privacy, employment, and transportation regulations
- Not use the Service to collect prohibited data (such as full Social Security numbers or payment card numbers)
5. Driver submissions
When a driver submits through an intake link, they represent that the information and photographs are current and accurate to the best of their knowledge. Each link is intended for a single submission unless otherwise indicated in the Service.
6. Acceptable use
You may not:
- Access or attempt to access data belonging to another brokerage or user
- Probe, scan, or test the vulnerability of the Service without authorization
- Interfere with or disrupt the Service or its security controls
- Upload malware, unlawful content, or content you do not have the right to share
- Reverse engineer or scrape the Service except as permitted by law
- Misrepresent your identity or affiliation
7. Intellectual property
We retain all rights in the Service, including software, branding, and documentation. You retain rights in data you or your drivers submit. You grant us a limited license to host, process, and display submitted data solely to operate the Service.
8. Confidentiality of intake links
Intake links are capability URLs. Anyone with a link may be able to submit before the link expires or is used. Treat links as confidential and share them only with the intended driver.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DRIVERSEAL AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the maximum extent permitted.
11. Indemnification
You agree to defend, indemnify, and hold harmless DriverSeal and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your submissions, your violation of these Terms, or your violation of any law or third-party rights.
12. Suspension and termination
We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms or pose a security risk. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory local law applies.
14. Changes
We may modify these Terms from time to time. Continued use after the effective date of updated Terms constitutes acceptance. If you do not agree, stop using the Service.
